HACC Gen — Terms of Use / Terms of Service

These Terms of Service ("Terms") govern your access to and use of HACC Gen, an AI-powered e-learning and training content generation platform operated by Dynamic Pixel Multimedia Solutions ("Dynamic Pixel", "HACC Gen", "we", "us", or "our").

By creating an account, accessing, or using HACC Gen, you agree to these Terms and the policies and terms incorporated into them. If you do not agree with these Terms, you must not access or use HACC Gen.

If you are using HACC Gen on behalf of a company, institution, or other organization, you represent that you have authority to accept these Terms on its behalf. In that case, "you" and "your" refer to both you and that organization.

1. About HACC Gen

HACC Gen is an AI-powered platform designed to facilitate human-AI collaboration for the creation, transformation, enrichment, and development of e-learning and training content.

Depending on the applicable plan and features, HACC Gen may provide capabilities including:

AI-assisted course and learning-content generation;
text generation and transformation;
document and source-content processing;
image generation;
audio generation;
video generation;
avatar and synthetic-media generation;
translation and language-related features;
instructional and assessment-content generation;
export of learning packages;
Moodle and other LMS integrations;
APIs and developer integrations; and
other current or future AI-assisted learning and content-development features.

Features available to you depend on your applicable plan, usage allowance, technical availability, and other applicable terms.

2. Eligibility and Account Registration

You must provide accurate and complete information when creating an account and must keep that information reasonably current.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.

You must not:

share your account credentials with unauthorized persons;
allow another person to use your account in violation of the applicable plan;
create an account using false or misleading information;
create multiple accounts for the purpose of circumventing usage restrictions; or
use another person's account without authorization.

You must notify HACC Gen promptly if you believe your account or credentials have been compromised.

HACC Gen may refuse, suspend, or terminate an account where permitted under these Terms.

3. Acceptance of Related Policies

Your use of HACC Gen is also subject to the following documents, as applicable:

Acceptable Use Policy;
Privacy Policy;
API Terms;
Data Processing Agreement, where separately executed; and
other terms expressly incorporated into these Terms.

These documents form part of the contractual framework governing your use of HACC Gen.

If a separately signed written agreement between you and Dynamic Pixel expressly conflicts with these Terms, that agreement will govern to the extent of the conflict.

4. Free and Paid Plans

HACC Gen may offer Free Plans, paid usage-based plans, enterprise arrangements, or other forms of access.

The features, usage allowances, pricing, credits, limitations, and conditions applicable to a particular plan are described in the applicable HACC Gen pricing, plan information, order information, invoice, or commercial agreement.

4.1 Free Plan

HACC Gen may provide a Free Plan with limited usage and features.

Free Plan usage may include limited allowances for text, images, audio, video, or other capabilities. Free Plan allowances are subject to the limits published by HACC Gen and may be changed from time to time.

Free Plan access does not necessarily constitute a recurring subscription.

4.2 Video Watermark

Videos generated under the Free Plan may include a visible HACC Gen watermark or branding.

Where a watermark is applied:

it is a feature of the Free Plan;
you may not remove, obscure, crop, manipulate, or circumvent the watermark;
you may use and distribute the video subject to the rights applicable to your plan; and
an eligible paid plan may provide watermark-free video generation or other branding options.

HACC Gen may change the placement, appearance, format, or technical implementation of the watermark.

Certain features may also require watermarking irrespective of plan due to third-party technology, licensing, or other applicable requirements.

4.3 Usage-Based Plans

HACC Gen may offer plans in which users purchase or consume usage-based credits or allowances rather than a recurring monthly or annual subscription.

The applicable pricing page, order information, invoice, or commercial agreement determines the applicable rates, credits, allowances, and features.

5. Payments, Credits and Taxes

Where paid services are offered, you agree to pay the applicable fees associated with your selected plan or usage.

Unless otherwise stated:

fees are based on the applicable pricing information at the time of purchase;
usage may be measured according to the applicable HACC Gen metering system;
taxes, duties, levies, or similar charges applicable to your purchase may be added where required;
you are responsible for providing accurate billing information; and
payment obligations are subject to the applicable pricing and plan information and any applicable commercial agreement.

Credits, allowances, or usage purchased for HACC Gen are not transferable unless expressly permitted.

HACC Gen may change pricing or introduce new charges for new or existing features subject to applicable notice requirements.

6. Refunds

Refunds, cancellations, unused credits, failed transactions, duplicate charges, and other payment matters are governed by the applicable HACC Gen pricing, plan, purchase, or commercial terms.

Unless otherwise stated in the applicable terms or required by applicable law, payment for consumed usage may not be refundable.

Nothing in these Terms limits any mandatory consumer rights that cannot lawfully be excluded.

7. Use of HACC Gen

Subject to these Terms and your applicable plan, Dynamic Pixel grants you a limited, non-exclusive, non-transferable, revocable right to access and use HACC Gen for legitimate purposes permitted by the Services.

You may use HACC Gen to create, develop, transform, or enhance learning and training content for your own educational, organizational, professional, or commercial purposes, subject to applicable plan restrictions.

You may not use HACC Gen except as expressly permitted by these Terms and applicable policies.

8. User Content

You may submit text, documents, files, images, audio, video, prompts, instructions, course material, data, or other content to HACC Gen ("User Content").

You retain ownership of your original User Content.

You grant Dynamic Pixel the rights reasonably necessary to host, process, transmit, transform, analyze, and otherwise use User Content as necessary to provide, maintain, secure, and improve the Services, subject to the HACC Gen Privacy Policy and any applicable agreement governing your account.

You represent and warrant that:

you own or have sufficient rights to submit your User Content;
you have obtained necessary permissions and consents;
processing the User Content through HACC Gen does not violate applicable law or contractual obligations; and
your User Content does not violate the Acceptable Use Policy.

You remain responsible for your User Content.

9. AI-Generated Output

HACC Gen may generate text, images, audio, video, assessments, courses, learning packages, or other output based on User Content, instructions, prompts, configurations, and AI technologies ("Generated Content").

AI-generated output may contain inaccuracies, omissions, bias, inappropriate material, errors, or other defects.

Generated Content may also be similar or substantially similar to content generated for other users.

You are responsible for reviewing and validating Generated Content before using, publishing, distributing, or deploying it.

HACC Gen does not guarantee that Generated Content will be:

accurate;
complete;
current;
error-free;
original;
suitable for a particular audience;
suitable for a particular purpose; or
free from third-party intellectual property rights.

You are responsible for determining whether Generated Content is appropriate for your intended use.

10. Rights in Generated Content

Subject to your applicable plan, these Terms, and third-party rights, HACC Gen permits you to use, modify, reproduce, publish, distribute, and otherwise exploit Generated Content for purposes permitted by your plan.

However:

HACC Gen does not guarantee exclusive ownership of Generated Content.
HACC Gen does not guarantee that Generated Content is legally protectable by copyright.
Generated Content may contain or be based upon material subject to third-party rights.
You remain responsible for obtaining any permissions required for third-party material.
Your rights to Generated Content may be limited by the terms of third-party services or content used in generating it.

Where a particular plan provides additional rights or restrictions, those plan-specific terms will apply.

11. Third-Party Content

HACC Gen may provide access to or incorporate third-party content, models, media, libraries, services, or technologies.

Third-party content remains subject to the rights and terms of the applicable third party.

You are responsible for determining whether you have the right to use, reproduce, modify, publish, or distribute third-party material included in or associated with Generated Content.

HACC Gen does not grant you ownership of third-party content merely because that content is accessible through the Services.

12. Intellectual Property of HACC Gen

HACC Gen and its underlying technology, software, interfaces, workflows, algorithms, databases, documentation, trademarks, logos, designs, plugins, HACC Gen Extender, and proprietary materials are owned by Dynamic Pixel Multimedia Solutions or the applicable licensors.

Except for the limited rights expressly granted under these Terms, no rights are transferred to you.

You may not copy, reproduce, modify, reverse engineer, distribute, sell, sublicense, or create derivative works of HACC Gen or its proprietary components except where expressly permitted by applicable law or written authorization.

"HACC Gen", its logos, branding, product names, and related marks may not be used in a way that suggests unauthorized endorsement, affiliation, or ownership.

13. Acceptable Use

Your use of HACC Gen is subject to the HACC Gen Acceptable Use Policy.

You must not use HACC Gen for unlawful, fraudulent, abusive, harmful, deceptive, malicious, or otherwise prohibited activities.

The Acceptable Use Policy forms part of these Terms.

A violation of the Acceptable Use Policy may constitute a violation of these Terms and may result in restriction, suspension, or termination of access.

14. API Access

Certain HACC Gen plans and integrations may provide access to APIs.

API use is governed by these Terms and the applicable HACC Gen API Terms.

API users must:

protect API keys, secrets, tokens, and other credentials;
comply with applicable usage and rate limits;
use APIs only for authorized purposes;
implement reasonable security measures;
prevent unauthorized access;
comply with applicable technical documentation; and
not resell or redistribute API access unless expressly authorized.

API credentials may be associated with a particular account, organization, application, LMS, domain, or other identifier.

HACC Gen may restrict API access where credentials are compromised, misused, shared improperly, or used in violation of applicable terms.

15. Integrations and Third-Party Platforms

HACC Gen may provide integrations with third-party platforms, including learning management systems such as Moodle.

Use of a third-party integration may require separate credentials, configuration, permissions, or third-party accounts.

You are responsible for:

maintaining your third-party accounts;
configuring integrations correctly;
protecting integration credentials;
complying with third-party platform terms; and
ensuring that your use of the integration is authorized.

HACC Gen is not responsible for changes made by third-party platforms that affect an integration.

16. Third-Party AI and Technology Providers

HACC Gen may use third-party providers for artificial intelligence, cloud computing, hosting, storage, image generation, audio generation, video generation, translation, communications, analytics, or other services.

The availability and behavior of certain HACC Gen features may therefore depend on third-party services.

Third-party providers may change, restrict, discontinue, or modify their services, which may affect corresponding HACC Gen functionality.

HACC Gen may replace or modify third-party technologies where reasonably necessary to operate or improve the Services.

17. Privacy and Data Processing

Your use of HACC Gen is subject to the HACC Gen Privacy Policy.

The Privacy Policy describes how Dynamic Pixel collects, uses, stores, processes, and protects personal information.

Where you use HACC Gen to process personal information belonging to your employees, customers, learners, clients, or other individuals, you are responsible for ensuring that you have the necessary legal basis, notices, permissions, and authorizations.

Where required, Dynamic Pixel may enter into a separate Data Processing Agreement with eligible organizations.

18. Confidentiality

You may submit confidential information to HACC Gen only where you are authorized to do so and where the applicable service and contractual arrangements permit such processing.

Dynamic Pixel will use commercially reasonable measures to protect information handled through the Services as described in the Privacy Policy and applicable agreements.

You should not submit information to HACC Gen where you are prohibited from doing so by law, contract, policy, or confidentiality obligations.

19. Prohibited High-Risk Reliance

HACC Gen is not intended to replace qualified professional judgment in areas where inaccurate information could cause significant harm.

This includes, without limitation:

medical and healthcare decisions;
legal decisions;
financial decisions;
employment decisions;
safety-critical decisions;
regulatory decisions; and
other high-risk applications.

You may use HACC Gen to assist with educational or training material concerning such subjects, but appropriate expert review remains your responsibility.

20. Service Availability

HACC Gen is provided on an evolving technology platform.

We do not guarantee that:

the Services will always be available;
the Services will be uninterrupted;
every feature will remain available;
AI generation will always succeed;
output will always be generated within a particular period;
integrations will always remain compatible;
third-party services will remain available; or
the Services will be completely free of errors or defects.

We may perform maintenance, updates, upgrades, security changes, or other modifications that temporarily affect availability.

21. Changes to HACC Gen

We may add, modify, replace, suspend, or discontinue features, models, integrations, interfaces, or other components of HACC Gen.

Where reasonably practicable, we will provide notice of material changes that significantly affect paid services.

We may make changes without advance notice where necessary to address security issues, legal requirements, technical problems, third-party service changes, or other urgent circumstances.

22. Security

You must not interfere with the security or integrity of HACC Gen.

You must not:

attempt unauthorized access;
probe or test vulnerabilities without authorization;
bypass security controls;
introduce malicious code;
interfere with platform infrastructure;
access another user's information;
circumvent usage or access restrictions; or
otherwise compromise the security of the Services.

If you discover a potential security vulnerability, you should report it to Dynamic Pixel rather than exploiting it.

23. Suspension and Termination

You may stop using HACC Gen at any time, subject to any outstanding payment or contractual obligations.

Dynamic Pixel may suspend or terminate access if:

you materially breach these Terms;
you violate the Acceptable Use Policy;
you engage in fraudulent or unlawful activity;
your use creates a security or operational risk;
you misuse API credentials or platform resources;
you attempt to circumvent usage or payment restrictions;
payment obligations remain unpaid;
suspension is required by law; or
suspension is reasonably necessary to protect HACC Gen, its users, or third parties.

Where reasonably practicable, we may provide notice and an opportunity to address the issue.

We may take immediate action without prior notice where necessary to address serious security risks, unlawful activity, fraud, abuse, or threats to the Services or others.

24. Effect of Termination

Upon termination or suspension, your right to access HACC Gen may immediately cease or be restricted.

Your rights regarding User Content, Generated Content, purchased credits, refunds, licenses, and exported materials following termination are governed by these Terms, the applicable pricing or plan information, and any separate agreement.

Termination does not automatically eliminate obligations that by their nature should survive termination.

25. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Dynamic Pixel Multimedia Solutions, HACC Gen, and their officers, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:

your violation of these Terms;
your violation of the Acceptable Use Policy;
your User Content;
your misuse of Generated Content;
your infringement or alleged infringement of third-party rights;
your unlawful use of the Services; or
your use of HACC Gen in violation of applicable law.

This obligation does not apply to the extent that a claim results from Dynamic Pixel's own established wrongdoing or liability that cannot lawfully be excluded.

26. Disclaimers

To the maximum extent permitted by applicable law, HACC Gen is provided on an "as available" and "as is" basis.

We make no warranties, express or implied, regarding:

accuracy of AI-generated output;
completeness of Generated Content;
fitness for a particular purpose;
merchantability;
uninterrupted availability;
compatibility with every system;
non-infringement of third-party rights in Generated Content; or
the results obtained from using the Services.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

27. Limitation of Liability

To the maximum extent permitted by applicable law, Dynamic Pixel Multimedia Solutions and HACC Gen will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, data, or anticipated savings arising from or relating to your use of the Services.

To the maximum extent permitted by applicable law, Dynamic Pixel's total aggregate liability arising out of or relating to the Services will be limited to the amount paid by you to Dynamic Pixel for the HACC Gen Services giving rise to the claim during the twelve months preceding the event giving rise to the claim.

This limitation does not apply to liability that cannot legally be limited or excluded.

28. Your Responsibility for Deployment

You are responsible for determining whether HACC Gen-generated content is suitable for your intended audience, jurisdiction, organization, course, training program, or commercial use.

You are also responsible for:

reviewing content before deployment;
ensuring appropriate accessibility and inclusivity;
verifying factual and regulatory information;
obtaining required approvals;
complying with applicable educational or professional standards; and
ensuring that final published content meets your organization's requirements.

HACC Gen is a content-development tool and does not assume responsibility for the educational, commercial, professional, or operational consequences of your deployment decisions.

29. Feedback

If you provide suggestions, ideas, feature requests, or other feedback regarding HACC Gen, you grant Dynamic Pixel permission to use that feedback without restriction or compensation, provided that such use does not disclose your confidential information.

You retain ownership of any underlying intellectual property in your feedback where applicable.

30. Electronic Communications

By using HACC Gen, you agree to receive electronic communications relating to your account, transactions, security, Services, and material policy or Terms changes.

You may also receive product or marketing communications where permitted by applicable law and subject to available communication preferences.

31. Changes to These Terms

We may update these Terms from time to time.

Changes may be made to reflect:

changes to HACC Gen;
new features or services;
changes in law or regulation;
security requirements;
changes to third-party technologies; or
changes in our business practices.

The updated Terms will be made available through HACC Gen.

Where required by applicable law, we will provide additional notice of material changes.

Your continued use of HACC Gen after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by law.

32. Governing Law and Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of India, without regard to conflict-of-law principles.

Subject to any mandatory rights or remedies available under applicable law, courts located in Ghaziabad, Uttar Pradesh, India will have jurisdiction over disputes arising from or relating to these Terms or the Services.

For enterprise customers or customers covered by a separate written agreement, the governing law and dispute-resolution provisions of that agreement may apply instead.

33. General Provisions

33.1 Entire Agreement

These Terms, together with the policies and agreements incorporated into them, constitute the agreement between you and Dynamic Pixel concerning your use of HACC Gen, unless a separate written agreement applies.

33.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

33.3 No Waiver

Failure to enforce a provision of these Terms does not constitute a waiver of our right to enforce that provision later.

33.4 Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where permitted by law.

Dynamic Pixel may assign these Terms in connection with a merger, acquisition, restructuring, sale of substantially all relevant assets, or similar transaction.

33.5 Force Majeure

Dynamic Pixel will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, war, civil unrest, government action, telecommunications failures, internet failures, cyber incidents, infrastructure failures, or failures of third-party service providers.

By creating an account, accessing, or using HACC Gen, you acknowledge that you have read, understood, and agreed to these Terms of Service and the policies incorporated into them.

HACC Gen is a product of Dynamic Pixel Multimedia Solutions ("Dynamic Pixel", "we", "us", or "our").

3. Content, Prompts and Files Submitted to HACC Gen

HACC Gen is an AI-assisted content-development platform. In the course of using the Services, you may submit or generate:

prompts and instructions;
text;
documents;
PDFs;
presentations;
images;
audio;
video;
course material;
instructional content;
learning objectives;
assessment content;
scripts;
source material;
other files; and
other information submitted for processing or generation.

We refer to these collectively as "User Content."

We process User Content as necessary to provide the features and functionality requested by you, including processing, transformation, analysis, generation, conversion, storage, export, and delivery of content.

You are responsible for ensuring that you have the right to submit User Content to HACC Gen and that you are authorized to provide any personal information contained in that content.

4. AI Processing

HACC Gen uses artificial intelligence technologies to generate, transform, analyze, summarize, translate, enrich, or otherwise process content.

Depending on the feature used, User Content, prompts, instructions, and related information may be processed by HACC Gen infrastructure and/or third-party technology providers that support particular AI or media-generation capabilities.

Such providers may include providers of:

AI models;
text generation;
image generation;
audio generation;
video generation;
avatar or synthetic-media generation;
translation;
cloud infrastructure;
storage; and
other technology required to operate the Services.

The specific providers used may change over time as we add, replace, or improve technologies.

We will use appropriate contractual, technical, and organizational measures when engaging third-party providers, as applicable.

5. How We Use Information

We may use information we collect for the following purposes:

processing User Content;

API credentials may be associated with a particular account, organization, application, LMS, or domain.

Where an organization controls the processing of personal information and HACC Gen processes that information on the organization's instructions, the organization may be the relevant Data Fiduciary or controller and Dynamic Pixel may act as a Data Processor or service provider, depending on applicable law and the specific arrangement.

HACC Gen may be used by educators, instructional designers, trainers, content developers, freelancers, e-learning companies, educational institutions, organizations, and other authorized users.

This Acceptable Use Policy (“AUP”) establishes the rules and standards governing the use of HACC Gen, including:

HACC Gen APIs;

2. User Responsibilities

Users are responsible for all activity conducted through their HACC Gen account, organization account, API credentials, integrations, or other authorized access.

Users must:

maintain the confidentiality of account credentials and API credentials;
take reasonable measures to prevent unauthorized access to their account;
ensure that content submitted to HACC Gen may legally be processed and used for the intended purpose;
ensure that they have the necessary rights, permissions, licenses, and consents for content submitted to HACC Gen;
review and validate AI-generated content before publishing, distributing, or deploying it;
ensure that generated learning material is appropriate for its intended audience and purpose;
comply with applicable laws, regulations, contractual obligations, and institutional policies; and
promptly notify HACC Gen of suspected unauthorized access, compromised credentials, or significant security concerns.

The user remains responsible for decisions and actions taken using HACC Gen-generated or HACC Gen-assisted content.

3. AI-Generated Content and Human Oversight

HACC Gen uses artificial intelligence and may use third-party AI technologies and services to generate, transform, summarize, translate, enrich, or otherwise process content.

AI-generated output may:

contain factual inaccuracies or omissions;
contain outdated information;
contain unintended bias;
contain inappropriate or unsuitable material;
contain errors in language, interpretation, instructional design, or assessment;
vary between generations;
resemble content generated for other users; or
otherwise require human correction or improvement.

Accordingly, HACC Gen does not guarantee that AI-generated output will always be accurate, complete, original, appropriate, or suitable for a particular purpose.

Users are responsible for reviewing, validating, editing, fact-checking, and approving generated content before it is:

published;
distributed;
incorporated into a course;
provided to learners;
used for assessment;
used commercially; or
otherwise made available to third parties.

HACC Gen is intended to assist human content development and decision-making. It is not intended to replace appropriate professional, instructional, editorial, legal, medical, financial, or other qualified judgment.

4. Prohibited Activities

Users may not use HACC Gen to:

4.1 Illegal Activities

Generate, upload, process, store, transmit, publish, or distribute content or material that violates applicable laws, regulations, court orders, or other legally binding requirements.

4.2 Harmful or Abusive Content

Create, promote, or distribute content that:

promotes or facilitates violence or physical harm;
promotes terrorism or violent extremism;
constitutes harassment, threats, or targeted abuse;
promotes hatred or unlawful discrimination;
encourages self-harm or harm to others; or
creates a significant and unreasonable risk of harm to individuals or groups.

4.3 Fraud and Deception

Use HACC Gen to:

impersonate another person or organization;
falsely claim an affiliation, endorsement, qualification, or authority;
facilitate fraud or identity theft;
create deceptive material intended to defraud or materially mislead others; or
deliberately misrepresent synthetic or AI-generated material as authentic where doing so would be unlawful or materially deceptive.

4.4 Intellectual Property Infringement

Users may not upload, generate, reproduce, transform, distribute, or otherwise use content in a manner that infringes another person’s or organization’s copyright, trademark, patent, trade secret, publicity rights, privacy rights, or other intellectual property or proprietary rights.

4.5 Malicious Software

Users may not use HACC Gen to create, distribute, deploy, or facilitate:

viruses;
worms;
ransomware;
malware;
malicious scripts;
credential-stealing tools;
destructive code; or
other software or material intended to compromise systems, networks, accounts, or data.

4.6 Unauthorized Access

Users may not attempt to:

access another user’s account or data without authorization;
bypass authentication or access controls;
obtain another user’s credentials or API keys;
exploit vulnerabilities without authorization;
interfere with the operation of HACC Gen;
conduct denial-of-service or similar attacks; or
circumvent technical safeguards.

4.7 Unauthorized Scraping

Users may not use bots, crawlers, scripts, scraping tools, or other automated mechanisms to systematically extract or collect information from HACC Gen except through officially provided and authorized APIs or other interfaces.

5. User Content and Third-Party Rights

Users are responsible for all text, documents, files, images, audio, video, data, prompts, instructions, course material, and other material submitted to HACC Gen (“User Content”).

Users represent and warrant that they have all rights, permissions, licenses, consents, and authorizations necessary to submit and process such User Content through HACC Gen.

Users must not submit content where doing so would:

violate a confidentiality obligation;
breach a contract;
infringe another person’s rights;
violate applicable privacy or data-protection laws; or
exceed the permissions granted to the user.
HACC Gen is not responsible for determining whether a user has sufficient rights to submit or use particular User Content.

6. Personal, Confidential and Sensitive Information

Users should exercise appropriate caution when submitting personal, confidential, proprietary, or sensitive information to HACC Gen.

Users must not knowingly submit information that they are not legally authorized to disclose or process.

This includes, where applicable:

passwords and authentication credentials;
payment card information;
banking credentials;
government identification information;
highly sensitive personal information;
confidential information belonging to another person or organization; or
other regulated or restricted information.

Where User Content contains personal information, the user is responsible for ensuring that its collection, disclosure, processing, and use through HACC Gen comply with applicable privacy and data-protection requirements.

HACC Gen’s processing of personal information is additionally governed by its Privacy Policy.

7. AI-Generated Images, Audio, Video, Avatars and Likeness

HACC Gen may provide tools for generating or transforming images, audio, video, avatars, voices, and other forms of synthetic media.

Users must use such features responsibly and lawfully.

Users must not, without appropriate authorization:

impersonate a real individual;
reproduce another person’s voice or likeness for deceptive purposes;
create fraudulent or defamatory synthetic media;
create content intended to falsely suggest that a person made a statement or endorsement;
use another person’s identity to deceive others; or
otherwise misuse synthetic media to violate another person’s rights.

Users are responsible for obtaining any required permission or consent before creating or distributing synthetic media involving identifiable individuals.

8. HACC Gen Free Plan and Watermarking

HACC Gen may provide certain features and usage allowances under a Free Plan.

The Free Plan is subject to the limits, features, and conditions published on the applicable HACC Gen pricing page.

The Free Plan currently provides a limited, one-time allocation of usage, including allowances for text, images, audio, and video generation. Free-plan usage does not constitute a recurring monthly or yearly subscription.

8.1 Video Watermark

Videos generated under the HACC Gen Free Plan may include a visible HACC Gen watermark or branding.

Where a watermark is applied:

it forms part of the Free Plan output;
users must not remove, obscure, crop, manipulate, or otherwise attempt to circumvent the watermark;
users may distribute the video subject to the rights and restrictions applicable to the Free Plan; and
upgrading to an eligible paid plan may provide watermark-free video generation or other branding options, subject to the applicable plan.

HACC Gen may change the placement, appearance, format, or technical implementation of the watermark from time to time.

HACC Gen may also determine that particular video-generation features or models are subject to watermarking regardless of plan where required by technology providers, licensing arrangements, or other applicable requirements.

9. Paid Plans and Usage-Based Services

HACC Gen may offer paid plans under which users purchase or consume usage-based credits or allowances.

Unless expressly stated otherwise, HACC Gen Flexible Plans are usage-based and do not constitute automatic monthly or yearly subscriptions.

The applicable pricing page, order information, invoice, or commercial agreement will determine the applicable:

usage allowances;
rates;
credits;
supported features;
limits;
payment requirements; and
other plan-specific conditions.

HACC Gen may introduce, modify, suspend, or discontinue particular features or generation capabilities subject to the applicable terms and notice requirements.

10. Usage Limits, Credits and Circumvention

HACC Gen may apply limits to:

text generation;
content generation;
images;
audio;
video;
API requests;
storage;
processing;
rate of requests;
or other resources.

Users must not circumvent, manipulate, or attempt to evade such restrictions.

Prohibited activities include:

creating multiple accounts primarily to obtain additional free usage;
manipulating usage measurement or metering;
circumventing payment requirements;
exploiting technical errors to obtain additional credits;
creating automated accounts;
transferring free allowances in an unauthorized manner; or
otherwise attempting to obtain Services beyond the limits of an applicable plan.

HACC Gen may restrict or suspend access where it reasonably determines that usage limits or metering mechanisms are being abused.

11. API Usage

Where HACC Gen provides API access, the API must be used in accordance with the applicable API plan, documentation, usage limits, and technical requirements.

API users must:

use only authorized API credentials;
keep API keys, API secrets, tokens, and related credentials secure;
prevent unauthorized persons from accessing such credentials;
comply with applicable rate limits and usage restrictions;
use the API only for authorized purposes; and
implement reasonable security measures within their own applications and systems.

API credentials must not be:

publicly exposed;
published in publicly accessible source code or repositories;
sold or transferred to unauthorized parties;
shared in a manner that permits unauthorized use; or
used to provide unauthorized access to HACC Gen.

HACC Gen API credentials may be associated with or restricted to a particular application, account, organization, or LMS/domain as determined by HACC Gen.

For example, HACC Gen’s Moodle integration requires API credentials and may associate those credentials with the registered LMS domain.

Users must not attempt to bypass such restrictions.

12. Automated Access and Integrations

Automated access to HACC Gen is permitted only through officially provided APIs, plugins, integrations, or other interfaces expressly authorized by HACC Gen.

Use of an authorized API or integration remains subject to:

applicable usage limits;
rate limits;
plan restrictions;
technical documentation;
security requirements; and
other applicable terms.

Users must not create unauthorized automated systems that reproduce or circumvent HACC Gen’s official integration mechanisms.

13. Commercial Use and Resale

Subject to the applicable HACC Gen plan, license, and commercial terms, users may use HACC Gen-generated content in their own educational, training, consulting, e-learning, or commercial projects.

However, unless expressly authorized by HACC Gen, users may not:

resell HACC Gen access as a standalone service;
sublicense or lease HACC Gen access;
provide unauthorized third parties with access to an account;
resell or redistribute API access;
sell or transfer HACC Gen credentials;
operate an unauthorized HACC Gen proxy or gateway; or
create a competing service primarily designed to reproduce or provide unauthorized access to HACC Gen functionality.

Use of HACC Gen-generated content does not automatically grant rights to third-party material incorporated into or used to generate that content.

14. Intellectual Property

Users retain ownership of their original User Content, subject to the rights necessary for HACC Gen to provide the Services.

Rights relating to AI-generated output are subject to the applicable HACC Gen plan, license, Terms of Service, commercial agreement, and any applicable third-party rights.

HACC Gen does not guarantee that generated content will be unique or that similar or substantially similar content will not be generated for other users.

HACC Gen’s software, platform, user interface, proprietary technology, algorithms, workflows, documentation, branding, trademarks, HACC Gen plugins, HACC Gen Extender, and other proprietary materials remain the property of Dynamic Pixel Multimedia Solutions or the applicable rights holder.

Nothing in this AUP transfers ownership of HACC Gen’s proprietary technology or intellectual property to users.

15. Third-Party Services and AI Technologies

HACC Gen may use third-party technologies and service providers, including providers of:

artificial intelligence models;
cloud infrastructure;
storage;
media generation;
voice and avatar generation;
translation;
analytics;
communications; and
other supporting services.

Certain features or outputs may therefore depend upon the capabilities, limitations, availability, policies, or terms of third-party providers.

Users acknowledge that HACC Gen may be unable to guarantee the continued availability or identical behavior of features that depend upon third-party services.

Users must not use HACC Gen in a manner that would knowingly cause HACC Gen or its service providers to violate applicable third-party requirements.

16. System Integrity and Fair Use

Users must use HACC Gen in a manner that does not unreasonably interfere with the availability, performance, security, or integrity of the Services or other users’ experience.

Users must not:

intentionally overload the platform;
generate excessive requests designed to degrade service performance;
interfere with another user’s access;
conduct unauthorized vulnerability testing;
reverse engineer or circumvent technical protections except where expressly permitted by applicable law;
exploit bugs or vulnerabilities for unauthorized benefit; or
otherwise abuse HACC Gen infrastructure.

HACC Gen may impose temporary or permanent technical restrictions where reasonably necessary to protect the Services, infrastructure, or users.

17. Academic and Professional Integrity

Where HACC Gen is used in an academic, professional, regulated, or institutional environment, users are responsible for complying with the applicable rules and policies of that environment.

This may include requirements relating to:

disclosure of AI-assisted work;
academic integrity;
attribution;
assessment design;
professional standards;
regulatory compliance; and
human review or approval.

HACC Gen does not determine whether a particular use of AI-assisted content complies with an institution’s or profession’s specific requirements.

18. High-Risk Uses

HACC Gen should not be relied upon as a substitute for qualified professional judgment in high-risk applications.

Users are responsible for obtaining appropriate professional review where content may influence decisions concerning:

healthcare or medical matters;
legal matters;
financial decisions;
employment decisions;
safety-critical activities;
regulatory compliance;
public safety; or
other matters where inaccurate information could result in significant harm.

HACC Gen may be used to assist in developing educational or training material concerning such subjects, but users remain responsible for appropriate expert review and validation before deployment.

19. Monitoring and Enforcement

HACC Gen may investigate suspected violations of this AUP and may take reasonable measures to protect the Services, users, third parties, and infrastructure.

Depending on the circumstances, HACC Gen may:

issue a warning;
restrict or remove violating content;
restrict functionality;
impose technical limitations;
suspend an account or API credentials;
terminate access; or
take other reasonable action.

HACC Gen may take immediate action without prior notice where reasonably necessary to address:

security risks;
unlawful activity;
serious abuse;
threats to users or third parties;
compromised credentials; or
significant disruption of the Services.

Where reasonably practicable, HACC Gen may consider the nature, severity, frequency, and circumstances of a violation when determining an appropriate response.

20. Reporting Violations

Users may report suspected violations of this AUP, unlawful activity, security concerns, or misuse of HACC Gen to the HACC Gen administration team.

Reports should contain sufficient information to allow HACC Gen to understand and investigate the concern.

21. Suspension and Termination

If access to HACC Gen is suspended or terminated because of a violation of this AUP, the user must not create another account or use another person’s account to circumvent the suspension or termination.

Rights concerning User Content, generated content, payments, refunds, credits, licenses, and exported materials following termination are governed by the applicable Terms of Service, plan terms, license terms, and other applicable agreements.

22. Service Availability and Changes

HACC Gen does not guarantee that every feature, AI model, integration, API, or generation capability will always be available, uninterrupted, error-free, or compatible with every third-party system.

HACC Gen may modify, improve, replace, suspend, or discontinue features from time to time.

Where a feature depends upon a third-party technology provider, changes made by that provider may affect the availability or functionality of the corresponding HACC Gen feature.

23. Relationship with Other HACC Gen Policies and Agreements

This AUP forms part of the rules governing the use of HACC Gen and should be read together with the applicable:

Terms of Service;
Privacy Policy;
Pricing and Plan Terms;
API Terms;
License Terms;
Data Processing Agreement, where applicable; and
other written agreements applicable to the user’s use of HACC Gen.

If a separate written agreement between HACC Gen and an organization expressly conflicts with this AUP, the terms of that written agreement will govern to the extent of the conflict.

24. Changes to This Policy

HACC Gen may update this AUP from time to time to reflect changes in:

technology;
Services;
laws and regulations;
security requirements;
AI capabilities;
business practices; or
platform features.

The updated version will be made available through HACC Gen or otherwise communicated where required.

Continued use of HACC Gen following the effective date of an updated AUP constitutes acceptance of the updated policy to the extent permitted by applicable law.

HACC Gen — API Terms

These API Terms (“API Terms”) govern access to and use of the HACC Gen Application Programming Interface (“API”) provided by Dynamic Pixel Multimedia Solutions (“Dynamic Pixel”, “HACC Gen”, “we”, “us”, or “our”).

The API is currently made available primarily for integration with HACC Gen-supported Moodle plugins and related integrations. These API Terms apply to any customer, organization, developer, administrator, or other authorized user (“API User”, “you”, or “your”) who accesses or uses the HACC Gen API.

By obtaining API credentials, configuring an HACC Gen integration, or using the API, you agree to these API Terms, the HACC Gen Terms of Service, Acceptable Use Policy, and Privacy Policy.

If there is a conflict between these API Terms and the HACC Gen Terms of Service, these API Terms will control only with respect to API-specific matters. The Terms of Service will otherwise continue to govern your use of HACC Gen.

1. API Access

1.1 Authorization

HACC Gen may provide you with API access subject to your applicable HACC Gen plan, credits, usage limits, subscription or purchase terms, and technical requirements.

API access is a limited, non-exclusive, non-transferable authorization to use the API for legitimate purposes permitted under these API Terms.

1.2 Current API Offering

HACC Gen currently provides API functionality primarily to support HACC Gen Moodle plugins and related integrations.

The API may enable an authorized Moodle installation or other supported integration to communicate with HACC Gen services and access functionality made available through the applicable integration.

HACC Gen may introduce additional API functionality, integrations, endpoints, or supported platforms in the future. These API Terms may apply to such functionality unless separate terms are provided.

1.3 Eligibility

You must have authority to use the HACC Gen account, Moodle installation, organization, or other system for which API access is being configured.

If you are using the API on behalf of an organization, you represent that you have authority to accept these terms on its behalf.

2. API Credentials and Security

2.1 API Credentials

API access may require credentials such as an API Key, API Secret, authentication token, or other credentials issued by HACC Gen.

API credentials are confidential and must be protected from unauthorized access.

2.2 Your Responsibility

You are responsible for:

keeping API credentials secure;
preventing unauthorized persons from accessing or using your credentials;
configuring integrations correctly;
restricting access to authorized administrators and systems;
promptly notifying HACC Gen if you believe credentials have been compromised; and
all API activity conducted using your credentials, except to the extent caused by HACC Gen's own unauthorized actions.

You must not publish API credentials in publicly accessible repositories, websites, documentation, client-side code, forums, or other publicly accessible locations.

2.3 Credential Rotation and Revocation

HACC Gen may require you to replace, rotate, or regenerate API credentials for security, operational, or technical reasons.

HACC Gen may revoke compromised, misused, or otherwise unauthorized credentials.

3. Moodle Plugin Integrations

3.1 Supported Integrations

Where the API is used through an HACC Gen-supported Moodle plugin, you are responsible for maintaining the Moodle environment and ensuring that the plugin is installed and configured appropriately.

3.2 Moodle Environment

You are responsible for:

your Moodle installation;
Moodle hosting and infrastructure;
Moodle administrator accounts and permissions;
third-party Moodle plugins and customizations;
the security of your Moodle environment; and
ensuring that users accessing HACC Gen functionality through Moodle are authorized to do so.

3.3 Plugin Compatibility

HACC Gen may update, modify, replace, or discontinue versions of its Moodle plugins or related API functionality.

HACC Gen does not guarantee that every version of Moodle, third-party plugin, hosting environment, customization, or infrastructure will remain compatible with the API indefinitely.

3.4 Domain Restrictions

Where supported, API credentials may be restricted to an authorized LMS or domain.

You must not attempt to bypass, disable, manipulate, or circumvent such restrictions.

4. API Usage, Credits and Limits

4.1 Plan-Based Access

API access and usage may be subject to the limits and entitlements of your applicable HACC Gen plan.

These may include limits relating to:

content generation;
text processing;
images;
audio;
video;
API requests;
storage;
processing capacity; or
other resources.

The specific allowances applicable to your account are those displayed in the applicable HACC Gen pricing, account, or service documentation.

4.2 Usage-Based Services

Where API usage is provided on a usage-based basis, usage may consume credits or other purchased allowances according to the applicable HACC Gen pricing and service terms.

You are responsible for monitoring your usage and maintaining sufficient credits or entitlement to continue using paid API functionality.

4.3 No Circumvention

You must not attempt to circumvent API limits, credits, authentication requirements, rate limits, domain restrictions, technical controls, or other usage restrictions.

This includes using multiple accounts, credentials, systems, requests, integrations, or technical mechanisms for the purpose of avoiding applicable limits or charges.

4.4 Fair Use

You must use the API in a manner that does not unreasonably interfere with HACC Gen's systems or the availability of the service to other customers.

HACC Gen may apply reasonable technical restrictions where necessary to protect system stability, security, performance, or availability.

5. Permitted Use

Subject to these API Terms, the Terms of Service, and the Acceptable Use Policy, you may use the API to:

connect supported Moodle installations or other authorized systems to HACC Gen;
access HACC Gen functionality made available through the API;
generate or process learning content and related educational materials;
support authorized users of your Moodle or other supported integration; and
perform other legitimate activities expressly supported by HACC Gen.

Your use must comply with all applicable laws, regulations, contractual obligations, and third-party rights.

6. Prohibited API Use

You must not use the API to:

violate applicable law or regulation;
infringe intellectual property, privacy, publicity, or other rights;
access accounts, systems, data, or services without authorization;
interfere with or disrupt HACC Gen systems;
introduce malware, malicious code, or harmful content;
probe, scan, or test HACC Gen systems for vulnerabilities without authorization;
circumvent authentication, rate limits, usage limits, credits, or other technical controls;
reverse engineer or attempt to extract the underlying source code, models, algorithms, or proprietary systems;
scrape or systematically collect HACC Gen services or outputs except through functionality expressly provided for that purpose;
use the API to build a substantially competing service by systematically replicating HACC Gen functionality;
use API credentials belonging to another person or organization without authorization;
resell or sublicense API access unless expressly authorized by HACC Gen; or
otherwise violate the HACC Gen Acceptable Use Policy.

HACC Gen may suspend or terminate API access where it reasonably believes that prohibited activity is occurring.

7. User Content and Data Submitted Through the API

7.1 Your Content

You may submit text, prompts, files, course materials, instructions, media, or other information through an authorized API integration (“User Content”).

You retain your rights in your User Content, subject to the rights necessary for HACC Gen to provide the services.

7.2 Authorization

You are responsible for ensuring that you have all necessary rights, permissions, consents, and legal authority to submit User Content through the API and to permit HACC Gen and its service providers to process that content as necessary to provide the services.

7.3 Personal and Confidential Information

You should not submit personal, confidential, sensitive, or regulated information through the API unless such submission is necessary for your intended use and you have an appropriate legal basis and authorization to do so.

You are responsible for configuring your systems and integrations appropriately to prevent unauthorized disclosure of such information.

7.4 Privacy

Information submitted through the API may be processed in accordance with the HACC Gen Privacy Policy and applicable contractual arrangements.

Where an organization uses HACC Gen on behalf of its users, the organization remains responsible for providing appropriate notices and obtaining any required permissions or consents relating to its users and data.

8. AI Processing and Generated Content

The API may provide access to AI-powered functionality, including content generation, transformation, translation, multimedia generation, summarization, and other processing.

AI-generated output may be inaccurate, incomplete, inappropriate, or unsuitable for a particular purpose.

You are responsible for reviewing and validating API-generated output before using, publishing, distributing, or relying upon it.

HACC Gen does not guarantee that AI-generated output will be unique, accurate, error-free, or suitable for every intended use.

Where the API is used to generate educational content, the API User remains responsible for appropriate instructional, factual, legal, regulatory, and quality review.

9. Third-Party AI and Technology Providers

HACC Gen may use third-party AI models, cloud infrastructure, storage services, media-generation services, translation services, analytics providers, or other technology providers to operate or support API functionality.

Your use of the API authorizes HACC Gen to process User Content and other necessary information through such providers to the extent required to provide the applicable services, subject to the HACC Gen Privacy Policy and applicable contractual terms.

HACC Gen may change or replace third-party technology providers where reasonably necessary to operate, improve, secure, or maintain the services.

10. Intellectual Property

10.1 HACC Gen Technology

The API, its software, documentation, interfaces, architecture, underlying technology, and related intellectual property remain the property of Dynamic Pixel or its licensors.

Except for the limited rights expressly granted under these API Terms and the Terms of Service, no intellectual property rights are transferred to you.

10.2 API Outputs

Subject to applicable law, third-party rights, and the HACC Gen Terms of Service, you may use API-generated output for your permitted business or educational purposes.

You are responsible for determining whether particular output can lawfully be used, published, distributed, or incorporated into your materials.

10.3 Feedback

If you provide suggestions, feedback, or recommendations concerning the API or related integrations, HACC Gen may use that feedback without restriction or compensation, provided that such use does not disclose your confidential information.

11. Commercial Use and Redistribution

Unless otherwise agreed in writing, API access is provided for use within your authorized systems and integrations.

You must not:

sell or sublicense API credentials;
provide API access to unauthorized third parties;
expose the API as an unrestricted public service using your HACC Gen credentials;
allow third parties to consume your API entitlement for their own independent purposes; or
commercially redistribute HACC Gen API functionality as a standalone service,

unless expressly authorized by HACC Gen in writing.

Use of the API to provide HACC Gen-powered functionality to authorized users of your own Moodle environment is permitted where supported by your applicable plan.

12. API Availability and Changes

HACC Gen will use reasonable efforts to maintain API availability but does not guarantee uninterrupted or error-free API operation.

The API may occasionally be unavailable because of:

maintenance;
upgrades;
security measures;
infrastructure failures;
third-party service interruptions;
network issues;
excessive or abusive usage; or
circumstances beyond HACC Gen's reasonable control.

HACC Gen may modify, add, remove, or discontinue API endpoints, features, functionality, technical requirements, or supported integrations.

Where reasonably practicable, HACC Gen may provide notice of material changes that are likely to substantially affect continued use of the API.

13. Security and Incident Response

HACC Gen may implement authentication, access controls, monitoring, rate limits, logging, and other reasonable security measures for the API.

You must promptly notify HACC Gen if you become aware of:

unauthorized API access;
compromised API credentials;
suspected security vulnerabilities affecting the API integration;
unauthorized access to User Content through the integration; or
other security incidents materially affecting your use of the API.

You must cooperate reasonably with HACC Gen in investigating and addressing such incidents.

14. Suspension and Revocation of API Access

HACC Gen may suspend, restrict, or revoke API access where reasonably necessary to:

protect the security or availability of HACC Gen systems;
address suspected unauthorized or abusive use;
prevent violation of these API Terms, the Terms of Service, or AUP;
comply with legal or regulatory requirements;
address non-payment or exhausted entitlements;
protect HACC Gen or other customers from material harm; or
address a security incident.

Where reasonably practicable and appropriate, HACC Gen may provide notice before suspension and an opportunity to resolve the issue.

Nothing in this section limits HACC Gen's ability to take immediate action where necessary to protect security, systems, users, or legal interests.

15. Fees, Payment and Taxes

API fees, credits, usage allowances, payment terms, taxes, refunds, and related commercial matters are governed by the applicable HACC Gen pricing and the Terms of Service.

Where API access is purchased on a usage-based basis, usage may be deducted from the applicable credits or allowances associated with your account.

Unless otherwise expressly stated, unused credits or allowances do not create a right to cash redemption or refund.

16. Relationship with Other HACC Gen Policies

Your use of the API is also governed by:

HACC Gen Terms of Service;
HACC Gen Acceptable Use Policy; and
HACC Gen Privacy Policy.

These API Terms supplement those documents and do not replace them.

The Acceptable Use Policy applies to API use in the same manner as it applies to other HACC Gen services.

17. Disclaimer

To the maximum extent permitted by applicable law, the API is provided on an “as available” and “as is” basis.

HACC Gen does not warrant that:

the API will always be available;
the API will be uninterrupted or error-free;
API-generated content will always be accurate or complete;
the API will satisfy every particular business or educational requirement;
the API will remain compatible with every third-party system or future version of Moodle; or
generated content will be free from errors, omissions, or unintended results.

You are responsible for evaluating and reviewing API outputs and ensuring that your implementation is appropriate for your intended use.

18. Limitation of Liability

HACC Gen's liability arising from or relating to API access and use is subject to the limitations and exclusions set out in the HACC Gen Terms of Service.

Nothing in these API Terms creates a separate or greater liability obligation beyond the limitations applicable under the Terms of Service, except where such limitation is prohibited by applicable law.

19. Indemnification

Your indemnification obligations relating to API use are governed by the HACC Gen Terms of Service.

You remain responsible for claims arising from your unlawful use of the API, unauthorized access, violation of third-party rights, misuse of User Content, or violation of these API Terms.

20. Changes to These API Terms

HACC Gen may update these API Terms from time to time.

If we make material changes, we may provide reasonable notice through the HACC Gen website, dashboard, email, or other appropriate means.

Your continued use of the API after the effective date of updated terms constitutes acceptance of the revised API Terms, to the extent permitted by applicable law.

21. Termination

These API Terms will remain applicable while you have API access or otherwise use the HACC Gen API.

Termination or suspension of your HACC Gen account, applicable plan, or API access may result in termination or suspension of your right to use the API.

Upon termination, you must stop using the API and must no longer use revoked API credentials.

Sections that by their nature should survive termination—including intellectual property, confidentiality, disclaimers, limitations of liability, indemnification, and applicable provisions concerning User Content—will survive termination.

22. General

If any provision of these API Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

Failure by HACC Gen to enforce a provision does not constitute a waiver of that provision.

These API Terms, together with the HACC Gen Terms of Service, Acceptable Use Policy, Privacy Policy, and applicable commercial terms, constitute the agreement governing your use of the API.

23. Governing Law and Jurisdiction

These API Terms will be governed by the laws specified in the HACC Gen Terms of Service.

Any dispute arising from or relating to API access or use will be subject to the jurisdiction and dispute-resolution provisions specified in the Terms of Service.
